1. Purpose

These terms govern the use of Pomelow, an online workspace (mail, calendar, chat, video calls, documents, file storage and add-ons) provided by Robin Bonnin ("we") to the organization that signs up (the "Customer") and to the people the Customer invites (the "Members"). Pomelow is intended for businesses and organizations, for professional use.

2. Account and organization

The person who creates the organization confirms they are authorized to bind the Customer and becomes its administrator. Administrators invite and remove Members and are responsible for how Members use the service. Everyone keeps their credentials confidential; we recommend turning on two-factor authentication.

The subscription is monthly, with no minimum term, and renews each month. The Customer can cancel at any time from the admin portal: it ends at the end of the period already paid, which is not refunded.

The Customer can also close their organization from the admin portal. The service then keeps working for 30 days so the Customer can retrieve their data; the closure can be cancelled during that time. After that, the Customer's data and its Members' accounts are deleted.

We may terminate the subscription if the Customer seriously breaches these terms and doesn't remedy it within 15 days of formal notice, or immediately in case of unlawful use that endangers the service or third parties.

5. Customer data

The Customer remains the owner of all data that it and its Members put into Pomelow (emails, messages, documents, files...). We use it only to provide the service, as set out in the data processing agreement, which forms part of these terms. We don't sell it or use it for advertising.

The Customer can export its Members' email and its member list at any time from the admin portal, and download its documents and files from the relevant apps.

6. Acceptable use

Pomelow must not be used to send unsolicited bulk messages, distribute unlawful content or malware, infringe third parties' rights, or attempt to compromise the security of the service or of other customers. We may suspend an account that breaks these rules, informing the Customer.

7. Availability and support

We make our best efforts to keep Pomelow available at all times, without guaranteeing a numerical availability level. Interruptions may occur for maintenance or incidents; service status is published on our status page. Support is provided by email at contact@pomelow.eu, on business days.

Pomelow is built on open-source software that we host, integrate and keep up to date. We may change the service; we notify the Customer before removing an essential feature.

8. Liability

Our liability is limited to direct, proven damages and capped at the amount paid by the Customer in the twelve months preceding the event. We are not liable for indirect damages (loss of revenue, customers, reputation...). Nothing in these terms limits liability that cannot be limited by law.

9. Personal data

Our privacy policy describes the data we process on our own behalf; the data processing agreement covers the data we process on the Customer's behalf.

10. Changes to these terms

We may change these terms. Any significant change is notified by email to administrators at least 30 days before it takes effect; a Customer who refuses it may cancel before that date.

11. Governing law

These terms are governed by French law. The French version prevails over any translation. Failing an amicable settlement, any dispute falls under the jurisdiction of the competent courts for Robin Bonnin's registered office.
